Children of separated couples taken into custody by the central and state governments
New Delhi | 6 July (National): Keeping in view the increasing divorce rate in India, the Matrimonial Disputes Redressal Forum (MDLRF) has written a letter to the central government with key recommendations. The Matrimonial Disputes Redressal Forum has expressed its concern that the Indian marital system, which has been a model for the world, is now completely in disarray, and almost 70 per cent of marriages end in divorce before even a year of marriage. It has been alleged that some women, in the name of marriage, eyeing their husbands' money and assets, separate before even a year has passed, and misuse the Domestic Violence Act to blackmail them for maintenance and climb the steps of the court demanding maintenance and husbands' assets. In this context, to protect the rights of husbands, a new provision called 4983, similar to IPC 498A, should be included, and the wife should be eligible to get maintenance from her husband only after at least seven years of cohabitation, the Bharatiya Janata Party (BJP) said.
It demanded that a provision be included in the BNSS. It suggested that the state or central governments should take custody of the children of separated couples, collect the expenses equally from both parents, arrange special hostels with special facilities for those children and provide them with good education and medical care. It is suggested to the central government that the governments should not forget the words of the elders that if any of them lack in the care and supervision of their parents, children grow up with a sense of inferiority in this society, and as a result, they become stupid or criminals. It warned that if these provisions are not included in the newly brought laws, they will remain irrelevant. It also suggested that these provisions will further improve the marital system, and the number of divorces and other marital crimes will decrease significantly.
1. Maintenance sirf un biwiyon ko milega jo shohar ke saath kam az kam saat saal guzar chuki hongi.
2. Juda hone wale parents ke bachon ki hifazat hukoomat karegi, dono se barabar kharcha vasooli hogi.
3. Bacchon ke liye khaas hostels banaye jayenge jahan taleem aur ilaj ki behtareen sahuliyat di jayegi.
4. Forum ka kehna hai ke kuch auratein shohar ki daulat pe nazar rakh kar jaldi talaaq le leti hain aur maintenance ka gala daba deti hain.
5. Agar yeh tajwez nayi kanoon mein shamil na hui to shadiyon ka system mazeed tabah ho jayega aur talaaq ka ratio asmaan choo lega.
